Herpository Terms of Service

These Terms of Service ("Terms") govern your use of Herpository. Herpository is operated by Herpository LLC ("Herpository", "we", or "us"), 146 Woodside Rd, Simpsonville, SC 29680, United States. By creating an account or continuing to use the service after these Terms change, you agree to these Terms and acknowledge the Privacy Policy. Contact support@herpository.app with questions.

1. Eligibility and Accounts

You must provide accurate account information and protect your password. You are responsible for activity under your account. Herpository is currently available only to residents of the United States. You must accurately attest to United States residence during registration or when an existing account is prompted. You must be at least 13 to use Herpository. You must be at least 18, or the age of legal majority where you live, to publish an animal listing, contact a seller about a transaction, or enter a sale. Listing access may not be used on behalf of a minor.

If you reside outside the United States, you may not create a new account or continue ordinary use of the service. Existing accounts that identify themselves as outside the United States receive limited access to export account information, manage existing billing, log out, and delete the account. Herpository may expand availability later, but no expansion is promised.

2. The Herpository Service

Herpository provides animal-care recordkeeping, husbandry reference information, reminders, exports, and tools that let users advertise animals through public links. Husbandry information is general educational guidance and is not veterinary advice. Contact a qualified reptile veterinarian for medical concerns.

Public listings are advertisements created by users. Herpository is not a marketplace operator, broker, seller, buyer, auctioneer, payment processor, escrow service, shipping provider, inspector, veterinarian, or party to a private transaction. We do not verify users, ownership, animal details, health claims, genetics, provenance, price, availability, permits, or listing accuracy. Users must perform their own due diligence.

3. Acceptable Use

You may use Herpository only for lawful animal care and responsible, humane recordkeeping or advertising. You must:

• Provide accurate, non-deceptive listing information and promptly remove unavailable animals.

• Disclose known health conditions, defects, sex uncertainty, genetic uncertainty, and material provenance information.

• Accurately disclose the animal's origin as captive bred, captive hatched, wild caught, or unknown. Do not guess when the origin is unknown.

• Accurately identify the species and disclose venom, envenomation, bite, or other handling hazards that a reasonable buyer would need to evaluate when relevant.

• Follow animal-welfare, wildlife, invasive-species, import, export, transport, permit, licensing, and sales laws in every relevant jurisdiction.

• Use humane housing, handling, packaging, transport, and transfer practices.

• Have the legal right to possess, advertise, and transfer every listed animal.

• Respect other users, buyers, sellers, support staff, and moderators.

4. Advertising Standards

When you publish an animal on a public page, you must:

• Advertise only an animal you own or are specifically authorized to advertise and that is in your or your local team's physical possession. Drop-shipping animals or advertising on behalf of a suspended user is prohibited.

• Describe the exact animal being offered. Species, sex, age or hatch date, weight when stated, genetics, origin, health, defects, provenance, identifiers, price, and availability must be as accurate and current as reasonably possible.

• Clearly label uncertain or possible genetics and never present a possible trait as proven. Hybrids and locality claims must be disclosed accurately.

• Use photos you have the right to use. A photo presented as the listed animal must show that exact animal. Any example or representative image must be clearly identified as such and must not be used to mislead a buyer.

• Disclose known illness, injury, deformity, mites, contagious conditions, feeding problems, reproductive limitations, and other facts material to welfare or a buyer's decision. An animal that is not suitable for breeding must not be advertised as breeder quality.

• Disclose wild-caught origin and retain any lawful-origin, import, permit, or acquisition records required for the transaction. If origin is contested, you may be required to provide supporting records to Herpository during moderation.

• Complete an appropriate quarantine and acclimation period before advertising a newly acquired or imported animal. Do not advertise an animal as established, healthy, or ready to ship unless that claim is accurate.

• State an honest asking price or clearly say that the price is negotiable, inquiry-only, or trade-only. Fake prices and bait-and-switch advertising are prohibited.

• Promptly remove or update animals that are sold, on hold, unavailable, or no longer accurately described.

Herpository may ask for photographs, records, permits, proof of possession, or other information when reviewing a report. Herpository does not routinely verify listings before publication, and the absence of a moderation action is not an endorsement or guarantee.

5. Prohibited Content and Conduct

You may not use Herpository to post or facilitate:

• Fraud, scams, stolen animals, false identities, deceptive genetics or provenance claims, counterfeit documents, or payment manipulation.

• Threats, harassment, hate speech, sexual content, animal cruelty, animal fighting, graphic abuse, or content that encourages harm.

• Malware, credential theft, spam, scraping, automated abuse, attempts to evade rate limits, or interference with the service.

• Another person's private information without permission.

• Content that infringes copyright, trademark, privacy, publicity, or other rights.

• Transactions that violate sanctions, export controls, wildlife laws, permit conditions, or other applicable law.

• Attempts to evade a takedown, seller suspension, user block, or moderation decision by changing links or creating another account.

Herpository has zero tolerance for objectionable content or abusive users.

6. Prohibited Animal Listings

The following may not be advertised through Herpository, even if possession may be lawful in a particular location:

• Species protected from commercial trade, including unlawfully traded endangered or threatened wildlife and CITES Appendix I specimens unless a lawful exception clearly permits the specific transfer.

• Stolen, poached, smuggled, illegally collected, or unlawfully imported animals.

• Wild-caught, captive-hatched, or captive-bred animals whose stated origin is false, misleading, or unsupported by documentation required for the transaction.

• Animals whose possession or transfer is prohibited where the seller, buyer, or animal is located.

• Venomous or otherwise dangerous animals offered without permits, licenses, secure transport, hazard disclosures, or other safeguards required in the relevant jurisdictions.

• Crocodilians, marine turtles, or other regulated wildlife offered in violation of a permit, quarantine, disease-control order, minimum age or size rule, transport restriction, or invasive-species rule.

• Animals presented as healthy when the seller knows they are ill, injured, contagious, or suffering from an undisclosed material condition.

Automated filters are not a determination that a listing is legal. A listing that passes a filter can still be removed. Users remain solely responsible for legal compliance and animal welfare.

7. User Content and Public Listings

You retain ownership of content you submit. You grant Herpository a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display that content only as needed to operate, secure, moderate, and improve the service. Public listing content and associated animal photos are intentionally visible to anyone with the public link.

You represent that you have the rights and permissions needed to submit your content. We may filter, limit visibility, preserve evidence, or remove content that violates these Terms, creates risk, or may be unlawful.

8. Reports, Blocking, and Moderation

Every public listing includes controls to report the listing or seller and to block that seller. Signed-in users can manage persistent seller blocks in Herpository. Reports may also be submitted at https://herpository.app/listing-safety or to support@herpository.app.

We target initial review of reports involving suspected illegality, fraud, credible threats, or immediate animal-welfare danger within 24 hours. Other reports are normally reviewed within three business days. We may temporarily hide content while investigating. We may request records, notify affected users, dismiss unsupported reports, remove an animal listing, suspend all public listings for a seller, restrict an account, preserve relevant evidence, or notify appropriate authorities when required by law or reasonably necessary to address an immediate danger.

If you provide an email address, we will send a report reference and may send the outcome when review is complete. A reporter can also check the status using the private reference link supplied after submission. We do not promise to disclose confidential evidence, another user's personal information, or internal security methods.

A seller may appeal a takedown or suspension within 14 days by emailing support@herpository.app with the moderation reference, relevant permits or records, and an explanation. Appeals are reviewed by a person who did not make the original decision when reasonably possible. Reinstatement is not guaranteed.

9. Private Transactions

Buyers and sellers are solely responsible for identity verification, due diligence, veterinary review, payment, taxes, permits, shipping, delivery, refunds, disputes, and compliance with law. Herpository does not hold funds or guarantee a transaction. To the fullest extent permitted by law, Herpository is not responsible for fraud, scams, misrepresentation, chargebacks, shipping problems, disease transmission, escape, injury, loss, death, illegal sales, or disputes arising from a private listing or transaction.

10. Paid Plans, Cancellation, and Refunds

The Free plan includes up to 3 animal profiles. Premium includes up to 50 animal profiles and the paid breeding, expense, profitability, and public listing tools described before purchase. Breeder includes everything in Premium and removes the animal-profile limit. Current prices, billing intervals, renewal terms, and any applicable taxes are shown before purchase. Unless a different offer is expressly displayed, paid plans are billed monthly and do not include a trial.

A paid subscription renews automatically until canceled. Paid-plan prices are offered in United States dollars. New subscriptions require United States residence and a United States billing country. We may reject, cancel, and refund a checkout that reports a non-US billing country. You can cancel through Manage Billing or through the payment provider used for purchase. Cancellation stops future renewals and normally leaves the paid plan active through the end of the billing period.

If an account moves to a plan with a lower animal-profile limit, profiles beyond that limit remain stored but become inaccessible. The oldest profiles remain accessible up to the new limit. The account holder can regain access by upgrading or by reducing the collection to fit the current limit. Downgrading does not automatically delete animal profiles or care records.

Except where required by law, subscription charges are non-refundable and we do not provide prorated refunds for unused time, account inactivity, feature non-use, or a cancellation made after renewal. We will review requests involving duplicate charges, unauthorized charges, or a verified failure to provide purchased access. Contact support@herpository.app promptly with the charge date and account email.

Purchases made through the Apple App Store or Google Play are also subject to that store's billing and refund rules, and refund requests may need to be submitted directly to the store. Stripe-processed subscriptions are managed through Herpository's Stripe billing portal. A moderation suspension does not automatically cancel a subscription; account holders retain access to care records and billing controls unless separate action is legally required.

We may change future prices or features with notice required by applicable law or the payment provider. A price change does not retroactively alter a completed charge.

11. Suspension and Termination

You may stop using Herpository and delete your account at any time. We may warn, restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created legal or safety risk, abused another person or animal, failed to pay applicable fees, or threatened the integrity of the service. Serious or repeated violations may result in immediate action.

Account deletion and subscription cancellation are separate actions. Review Manage Billing before deleting an account. Sections that by their nature should survive termination, including ownership, transaction responsibility, disclaimers, liability limits, dispute terms, and moderation evidence retention, continue to apply.

12. Service Availability and Disclaimers

The service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee uninterrupted operation, error-free reminders, permanent availability of public links, listing accuracy, animal health, transaction completion, or fitness for a particular purpose. Keep independent copies of records needed for veterinary, tax, breeding, permit, or legal purposes.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Herpository and its personnel are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, animal loss, or private-transaction disputes arising from the service. Where liability cannot be excluded, total liability is limited to the amount you paid Herpository during the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing, unless applicable law requires a greater remedy.

14. Changes to These Terms

We may update these Terms as the service changes. Material changes require review and acceptance in the app before continued use. The effective date and version identify the current Terms.
